24/7 Availability to Answer Your Questions: (240) 752-6041

Assault is charged against someone who knowingly and intentionally causes or attempts to cause severe physical injury toward another person, whether through bodily contact or with a weapon such as a knife, firearm, or any object that can cause serious harm. Prosecutors will fight hard to convict you and ensure that you get the highest amount of penalties available. If you are convicted, you could be facing prison time, fines, restitution, and life with a violent offense on your permanent record.

Why Choose Our Assault Defense Lawyers?

After an arrest, it is important that you contact the Law Offices of Maria Mena to speak with a seasoned criminal defense lawyer about your case. We know how to get charges dropped or reduced, and we have the results to prove it.

1st Degree Assault vs. 2nd Degree Assault

Law enforcement officers who respond to an accusation of assault only need a witness statement and evidence of an injury in order to place you under arrest. Depending on the circumstances of your case, you may be charged with a misdemeanor or a felony and face varying penalties.

In Maryland, Assault Is Broken into Two Categories:

Assault in the first degree is charged when serious physical injury is caused. Serious physical injury involves the following:

  • Substantial risk of death
  • Disfigurement
  • Impairment or loss of bodily members or organs
  • Any other permanent or long-term damage

First degree assault incurs penalties of up to 25 years in prison.

Assault in the second degree is charged when physical injury is caused or reasonable fear of physical injury was caused. Second degree assault incurs penalties of up to 10 years in prison and fines of up to $2,500.
